Terms of Service

1. Acceptance of Terms

By accessing or using the Unreality3D platform ("Service"), operated by Unreality3D LLC ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

2. Description of Service

Unreality3D is a Unity 6+ WebGL content creation and publishing platform that enables:

• Creation and publication of interactive 3D content
• Quest systems and interactive gameplay elements
• Content monetization through PayPal integration (optional)
• Professional creator URLs and automated GitHub publishing
• Community features and content sharing
• Real-time multiplayer experiences (coming Q3 2025)

3. User Accounts

Account Types

• Visitor: Basic access to browse and experience content
• Creator: Ability to publish and manage content (no PayPal required)
• Seller: Monetization features requiring verified PayPal Business account

Account Requirements

• You must be at least 13 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining account security
• One person may not maintain multiple accounts
• PayPal Business account required only for content monetization/selling

4. Content Guidelines

Acceptable Content

• Interactive games and experiences
• Educational and artistic content
• Original creative works
• Content complying with Unity 6+ WebGL standards
• Quest-based adventures and interactive narratives

Content Ownership

• You retain ownership of your original content
• You grant us a license to host and distribute your content
• You must have rights to all content you upload
• We may remove content that violates these Terms
• Your GitHub repositories remain under your full control

5. Creator Responsibilities

• Technical Compliance: Content must meet Unity 6+ WebGL standards
• Performance: Content must not exceed resource limits
• Moderation: Respond to user reports within 48 hours
• Accuracy: Provide accurate content descriptions and pricing
• GitHub Management: Maintain your repositories and deployment settings

6. Payment Terms

Revenue Sharing

• Creator Payout: 95% of net revenue from content sales
• Platform Fee: 5% to support platform operations
• Payment Processing: Handled securely through PayPal
• Free Content: No fees for creators publishing free content

Payout Requirements

• PayPal Business account required only for monetization: Creators can publish free content without PayPal
• Verified PayPal Business account required for selling content
• Minimum payout threshold: $50 USD
• Payouts processed weekly for eligible sellers
• Tax reporting responsibilities belong to creators

7. Platform Usage

Permitted Uses

• Creating and sharing interactive 3D content
• Using Quest System and interactive tools
• Participating in community features
• Using provided development tools and SDK
• Monetizing original content through platform features (with PayPal Business account)
• Publishing through automated GitHub integration

Prohibited Activities

• Violating intellectual property rights
• Attempting to circumvent platform security
• Spam, harassment, or abusive behavior
• Distributing malware or harmful code
• Creating multiple accounts to evade restrictions
• Interfering with automated deployment systems

8. Intellectual Property

• Platform technology and trademarks remain our property
• You may not reverse engineer or copy platform features
• SDK and tools are provided under separate license terms
• We respect intellectual property rights and expect users to do the same
• Unity 6+ templates and tools are subject to Unity's license terms

9. GitHub Integration

• Repository creation and management through platform tools
• Automated deployment and professional URL generation
• You maintain full ownership and control of your repositories
• Platform accesses only information necessary for publishing
• You may disconnect GitHub integration at any time

10. Privacy and Data

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Service Availability

• We strive for high uptime but cannot guarantee uninterrupted service
• We may perform maintenance that temporarily affects availability
• We reserve the right to modify or discontinue features
• Critical updates will be communicated through the platform
• GitHub integration depends on GitHub's service availability

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNREALITY3D LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

13. Indemnification

You agree to indemnify and hold harmless Unreality3D LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Termination

• You may terminate your account at any time
• We may suspend or terminate accounts for Terms violations
• Upon termination, you may export your content within 30 days
• Payment obligations survive account termination
• GitHub repositories remain under your control after termination

15. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the state of incorporation of Unreality3D LLC.

16. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the platform or email. Continued use of the Service constitutes acceptance of modified Terms.

17. Governing Law

These Terms are governed by the laws of the state where Unreality3D LLC is incorporated, without regard to conflict of law principles.
